Terms of Use
These terms apply to the restricted pre-release version of Same Sky operated by rnodern. By creating an account or using the app, you agree to these terms and the privacy policy.
Eligibility and pre-release access
You must be at least 18 years old and personally invited to the restricted TestFlight programme. Access is personal, may be limited or withdrawn, and does not promise a future public release.
Use Same Sky safely
Same Sky is for voluntary, consensual communication between two people. It is not an emergency, navigation, tracking, medical or safety service. Do not use it while driving or when attention to the app would be unsafe. Direction and distance may be delayed, approximate or wrong because of permissions, sensors, network conditions or the quality of a shared sample.
Consent and acceptable use
Use Same Sky only with a partner who has freely chosen to connect. Share only your own current spot or a place you are entitled to share. You must not use Same Sky to stalk, threaten, harass, deceive, monitor without consent, break the law, probe the service, interfere with another account or attempt to defeat security or rate limits.
Accounts and devices
Provide accurate account information, keep your credentials and devices secure, and promptly revoke a lost or untrusted device. You are responsible for activity performed through your account until access is revoked. Pairing and device approval are security boundaries; do not approve a person or device you do not recognise.
Encryption and recipient control
Private feature content is designed to be end-to-end encrypted between approved devices, but encryption does not control the person receiving it. A recipient may save, photograph, copy or disclose information after decryption. Withdrawal, expiry, unpairing and deletion cannot erase a copy already retained elsewhere.
Availability and changes
This is pre-release software. Features may change, fail, be delayed or be unavailable; TestFlight builds may expire. rnodern may suspend the service to protect users, privacy, security or reliability. Backwards-incompatible security changes may require an update or a new pairing.
Ending use
You may stop using Same Sky, unpair, revoke devices or request account deletion through the app. rnodern may suspend or end access for unsafe, abusive or unlawful use, a security risk, or the end of the validation programme.
Consumer rights and liability
Nothing in these terms excludes rights or guarantees that cannot lawfully be excluded, including applicable Australian Consumer Law rights. To the extent permitted by law, the pre-release service is provided without promises of uninterrupted availability or fitness for safety-critical use, and rnodern is not responsible for loss caused by relying on Same Sky as an emergency, navigation, tracking or safety service.
Changes and contact
Material changes will be reflected by updating the effective date and, where appropriate, communicated through the app or TestFlight information. Questions about these terms can be sent through Same Sky support.
